Please read these Terms & Conditions carefully before placing an order or subscribing to a veg box through our shop at shop.cullernegardens.uk. By placing an order you agree to these terms.

1. About us

The Cullerne Gardens veg box service is a project operated by Ekopia Social Investments Ltd, based at the Park Ecovillage Community, Findhorn, Scotland.

Ekopia Social Investments Ltd is the seller of the goods and the contracting party for all orders placed through shop.cullernegardens.uk.

The shop is powered by Ooooby, which provides the e-commerce platform and manages your account and order interface.

Payments are processed securely by Stripe. By using the shop you also agree to Ooooby’s Terms of Service.

2. Our products

We sell seasonal vegetable boxes and related produce grown at Cullerne Gardens and, where necessary to supplement supply, sourced from trusted local and regional growers.

Box contents vary week to week depending on what is in season and available. We do not guarantee a fixed contents list. Where possible, a preview of that week's box contents will be displayed in the shop ahead of your delivery date.

If there is a specific item you cannot or do not wish to receive, you may request an exclusion by contacting us at hello@cullernegardens.uk or via your Ooooby account. We will do our best to accommodate exclusions but cannot guarantee this in every case.

3. Subscriptions

Our veg boxes are available as a recurring subscription. When you subscribe you are signing up for a continuing weekly delivery until you choose to cancel.

There is no minimum subscription period. You are free to cancel at any time (see section 6).

Your subscription will continue and you will be charged accordingly until you actively cancel it through your Ooooby account or by contacting us directly.

4. Pricing and payment

Prices are displayed in pounds sterling (£) inclusive of any applicable VAT.

We reserve the right to change our prices at any time. We will give you reasonable notice of any price changes, and you will have the opportunity to cancel before the new price takes effect.

Payments are processed securely by Stripe on our behalf. You will be charged after each delivery has been completed. In the case of advance billing, you may be charged for a set number of upcoming deliveries at the start of a billing period. This will be made clear at the point of sign-up.

Ekopia Social Investments Ltd does not store your card details. All payment information is handled securely by Stripe in accordance with their Privacy Policy.

If a payment fails, you will be notified and Stripe will attempt to collect any outstanding balance in the next billing cycle. If payment cannot be collected, we reserve the right to pause your subscription until the balance is cleared.

5. Delivery

We deliver to addresses within our local delivery area. The full delivery area and any applicable delivery charges are shown in the shop at shop.cullernegardens.uk at the point of checkout.

We will do our best to fulfil every scheduled delivery. In exceptional circumstances such as severe weather, crop failure, or other events outside our control, we may need to cancel or delay a delivery. In such cases we will notify you as soon as possible and you will not be charged for any delivery that does not take place.

If you are not available to receive your box, please make arrangements for it to be left in a safe place. Where you request that a delivery is left unattended, we cannot accept responsibility for loss or damage after delivery, to the extent permitted by law.

6. Pausing or cancelling

You can cancel your subscription at any time through your Ooooby account or by emailing hello@cullernegardens.uk. Cancellation takes effect from the next scheduled delivery after your request is received. Any outstanding balance for deliveries already made will still be collected.

As crops are planned in advance we cannot pause or skip individual deliveries if you are away for a time. However, we can donate your box to a local food scheme on your behalf, or you can pass it on to a friend.

7. Your right to cancel (UK consumer law)

Under the Consumer Contracts Regulations 2013, you have the right to cancel a one-off order within 14 days of purchase, provided the goods have not yet been dispatched.

Please note that this 14-day cancellation right does not apply to perishable goods or to boxes that have already been packed and are ready for dispatch. As fresh produce, veg boxes are perishable and we are unable to accept returns once a box has been delivered.

If you believe your box was incorrect, damaged, or of unsatisfactory quality, please contact us within 48 hours of delivery at hello@cullernegardens.uk and we will arrange a replacement, credit, or refund in line with your statutory rights.

8. Refunds

Refunds or credits will be considered in the following circumstances:

A delivery did not take place and you were charged for it

The box contents were significantly different from what was described, beyond normal seasonal variation

The produce was in an unsatisfactory condition upon delivery

We will assess each case fairly and in line with your statutory rights. Where appropriate, we may offer a replacement, credit, or refund.

We do not offer refunds for changes in personal preference or for skipped deliveries that were not cancelled before the cut-off date.

Refunds will be processed within 14 days of being agreed, to the original payment method via Stripe.

9. Seasonal variation and availability

Our produce is grown regeneratively and seasonally. The contents of your box will vary throughout the year and from week to week. This is a natural and intentional feature of what we do, not a fault. By subscribing you acknowledge and accept that box contents are variable.

In the event of crop failure or limited availability, we may substitute items with produce of equivalent value from trusted local sources.

10. Liability

Ekopia Social Investments Ltd is not liable for any losses that are not reasonably foreseeable at the time of order, or for losses arising from circumstances beyond our reasonable control.

Nothing in these Terms & Conditions affects your statutory rights under UK consumer law.

11. Complaints

If you have a complaint, please contact us in the first instance at hello@cullernegardens.uk. We will acknowledge your complaint within 3 working days and aim to resolve it within 14 days.

12. Changes to these terms

We may update these Terms & Conditions from time to time. The current version will always be available at cullernegardens.uk/terms-conditions. Continued use of the shop after changes are posted constitutes acceptance of the updated terms.

13. Governing law

These Terms & Conditions are governed by the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
